Privacy is a fundamental right, and at Ekaimpact (Ekaimpact/Us/We/Our), it is treated as such. As part of Your use of the Platform, We may collect and process Your Data. This privacy policy (Privacy Policy) provides how such data is collected, used, shared and the manner in which we protect the Personal Information on the use of the website at https://www.ekaimpact.org (Platform). This Privacy Policy provides the policy for collection and processing of data of SPOs’, Donors, any person visiting the Platform, any users of the Platform or such other person who has provided Us information in relation to the Services who has/is deemed to have accepted this Privacy Policy (You). This Privacy Policy forms part of the terms of use of the Platform as accessible at https://www.ekaimpact.org/terms (Terms of Use), and the references to SPOs’ and Donors shall have the same meaning ascribed to it in the Terms of Use. It is clarified that any reference to You or Your information made in this Privacy Policy is intended to also mean the organisation or entity that you represent and the information of such organisation or entity.

 

This Privacy Policy and the Terms of Use as available and uploaded on the Platform, or any other specific terms and conditions, as applicable or relating to the use of any services or facilities available on the Platform (Services), shall constitute the entire legally and binding agreement between You and Us in connection with Your access, usage, visit or use of the Platform and/or the Services, in any manner. Please read this Privacy Policy document, along with the Terms of Use, carefully before You access the Website. By using the Services or by otherwise giving Us Your information, You will be deemed to have read, understood and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by this Privacy Policy.

 

You hereby consent to Our collection, use, sharing and disclosure of Your information as described in this Privacy Policy. If You do not agree with the Privacy Policy or Terms of Use or do not fully understand the terms therein, please do not use the Platform and/or provide us Your information.

 

Any term which is undefined herein, shall be construed to have the same meaning as provided in the Terms of Use.

 

  1. PERSONAL INFORMATION 

    1. While accessing and/or using Our Platform, We may ask You to provide Us with certain information which may be generic or personally identifiable information that can be used to contact or identify You, which may include Your and/or Your organisation’s name, email address, postal address, phone number, details of activities, financial and commercial information, details with respect to Your business, manner of use of the Services or any other information You voluntarily provide to Us in any form, way or manner (Personal Information).

    2. We understand that the Personal Information is extremely private to You and assure You that it will be used only for providing the Services as mutually agreed to be rendered by us, and as stated under this Privacy Policy.

    3. We will not access information without Your explicit consent (as provided on the acceptance of this Privacy Policy). You have the option not to provide Us with consent or to subsequently revoke consent to the collection of Personal Information.

  2. HOW WE COLLECT INFORMATION

    1. ​The Personal Information that We collect are only as required to provide Our Services and for Us to better understand Your interests. We may collect information through various means including but not limited to the following:

      1. While you [register / sign up / create a profile] on the Platform;

      2. When You sign up or subscribe to any Services;

      3. When You provide Your Information to us when you interact with the Platform.

      4. When you provide us Your information through any external mediums such as phone calls, virtual or in person meetings, forms, links, emails, Whatsapp or other messaging platforms, other forms of digital or physical communication, or in any other manner;

      5. When You use the features on Our Platform and/or when You use Services;

      6. When You access the Platform or Services; or

      7. By use of cookies.

    2. We may use third-party service providers to serve ads and perform data analytics on Our behalf across the internet and sometimes on this Platform. They may collect anonymous information about Your visits to Our Platform and Your interaction with Our Services. No personally identifiable information is collected or used in this process. We do not provide them access to any personally identifiable information, unless you provide consent for the same.

    3. When You visit the Website, We automatically receive the URL of the site from which anyone visits. We also receive the Internet Protocol (IP) address of Your computer (or the proxy server You used to access the World Wide Web), the computer operating system and type of web browser, email patterns, as well as the name of Your ISP. This information is used to analyse overall trends, understand user behaviour and to help Us improve Our Service. We may use the services of third party analytics tools or products for this purpose and we may share your Personal Information to such third parties as required. Further, such third party services may collect your information on your interaction with the Platform as well. Notwithstanding the above, We may share and/or disclose some of the aggregate findings (not the specific data) with advertisers, sponsors, investors, strategic partners, and others in order to help grow Our business.

    4. We do not trade or sell Your Personal Information in any manner, except as specified herein, or without taking consent from You.

    5. Some of the Services provided on the Platform may require payment. The payments for the Services are done through third party payment services. We do not store or process any of Your financial information such as bank accounts, credit and debit card details or other payment instrument details.

    6. We may obtain information about You from other sources, including through third party services and organizations, to supplement information provided by You. For example, if You access the Platform through a third-party application, such as an app store, a third-party login service, or a social networking site, We may collect information about You from that third-party application that You have made public via Your privacy settings.

  3. HOW THE INFORMATION COLLECTED IS USED?

    1. We collect Your Information for various purposes, including the following:

      1. for all purposes that may be related to providing the Services;

      2. sharing the information with SPOs’ or Donors as may be required to effectively perform the Services;

      3. for enabling communication between You and Us (which includes any third-party service providers or vendors that we have authorised for this purpose) as may be required for the performance of the Services, by any modes of communication, including but not limited to emails, phone calls, letters, notifications, text, Whatsapp or other forms of messages, etc.;

      4. to provide You with information about the Services available on the Platform;

      5. to personalize Your experience on the Platform;

      6. for research, statistical analysis and business intelligence purposes in an aggregated or non-personally identifiable form;

      7. for the purpose of enabling communication between the SPOs’ and Donors;

      8. to enable any of our vendors or service providers to provide their services to Us, in relation to the implementation of the Services.

      9. for obtaining feedback in relation to the Services;

      10. customer support related issues;

      11. for proper administration of the Platform;

      12. to conduct internal reviews and data analysis for the Platform (e.g., to determine the number of visitors to specific pages within the Platform);

      13. to improve the Services, content and advertising on the Platform;

      14. to protect the integrity of the Platform;

      15. to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law; and

      16. to make disclosures as may be required under applicable law; and

      17. for all purposes as may be required for the effective performance of the Services.

    2. You acknowledge that the information that You have provided to Us is intended to be used for the effective performance of the Services and that We intend to publish such information on the Platform as well as share with other Donors, SPOs’, their partners, affiliates, Our vendors and service providers, and such other persons that may be required to receive such information in furtherance of or for the performance of the Services.

    3. You hereby provide us Your explicit consent for such publication and dissemination and You acknowledge and agree that You are consenting to the continuous dissemination of your Personal Information to others and further acknowledge that We will not be liable for any consequences of such publication or dissemination.

  4. SHARING OF INFORMATION

    1. Without prejudice to any other provisions of this Privacy Policy, We may also transfer or disclose your information as provided under:

      1. To law enforcement agencies in connection with an investigation having the interest of general public at large, subject to due process of law;

      2. To Our associates, vendors, service provider and affiliates to help detect and prevent fraud, identity theft and other illegal activities, correlate related or multiple accounts to prevent abuse of Our Services;

      3. To Our affiliates, employees, associates, vendors or service providers, for the purpose of enabling Us to provide the necessary Services;

      4. We shall also share such information with Our associates or affiliates should We decide to undergo restructuring in anyway or is acquired by any other entity and ensure that in such an event the other entity continues to follow this Privacy Policy strictly.

    2. Collection, use and disclosure of information which has been designated as ‘Personal Information’ or ‘Sensitive Personal Data or Information’ under Information Technology (Reasonable Security Practices And Procedures And Sensitive Personal Data Or Information) Rules, 2011 requires Your express consent. By affirming Your assent to this Privacy Policy, You, provide Your consent to such use, collection and disclosure, as required under applicable law.

  5. DATA RETENTION

    1. We will only retain Your Personal Information for as long as may be necessary for the performance of the Services and for the effective and safe functioning of the Platform, including for the purposes of satisfying any legal, accounting, or reporting requirements. We reserve the right to retain your Personal Information for the purposes of maintaining records.

    2. In some circumstances, We may anonymize Your Personal Information (so that it can no longer be associated with You) for research or statistical purposes in which case We may use this information indefinitely without further notice to You.

  6. TRANSFER OF YOUR PERSONAL INFORMATION

    1. Your Personal Information is processed at Our operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to and maintained on computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may be different to those from Your jurisdiction.

    2. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer

  7. AUTHORIZED THIRD PARTY ACTIVITIES

    1. Links to third-party websites or any third party electronic communication service may be provided on the Platform which are operated by third parties and are not controlled by, or affiliated to, or associated with Us. The existence of these links do not in any way imply that we endorse the said linked website, the providers of the website or the information included in such links. Your interaction with any such linked website is entirely at Your own risk. We do not make any representations concerning the privacy practices or policies of such third parties or terms of use of such third party websites, nor do We control or guarantee the accuracy, integrity, or quality of the information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials available on such third party websites. Your use of a linked website and the information provided by You to such third party websites is subject to the terms and conditions and privacy policies of that site and We cannot be in any manner considered to be a party to any transactions You make on such linked website and we are not responsible for any transactions or interactions therein. It is recommended that You review the privacy policy of such third party websites prior to using such websites. 

    2. We may share Personal Information, including stored cookies with entities that provide services to Us, including companies that provide web analytics, storage, email distribution and other services. The use of Personal Information by such companies is limited to the purpose of rendering the contracted services.

  8. ACCESS TO USER INFORMATION

    1. If we have collected Personal Information from You, You may make a request to exercise the following rights:

      1. The right to withdraw Your consent at any time where we rely on Your consent to process Your Personal Information;

      2. A right to have Your information rectified if such information is found to be incomplete or inaccurate;

      3. A right to object to Us processing data collected from You;

      4. A right to request that we restrict the processing of Your Personal Information;

      5. A right to be notified in the event of a breach of any Personal Information collected by the Platform.

      6. A right to access, update or to delete information that We have on You; and

      7. The right to be provided with a copy of Your Personal Data in a structured, machine-readable and commonly used format;

    2. It is clarified that any rights that You may have under this Clause shall only be applicable and made effective 15 (fifteen) days from the date of request for the exercise of such right and not to any consents, approvals or processing of information that has already taken place prior to such date.

    3. You may decline to submit identifiable information through the Platform, in which case You may not be allowed to access certain features / parts of the Platform.

    4. If You believe that any of Your Personal Information held by Us is inaccurate, and there is no option provided within the Platform to correct or update such information, or if You would like to exercise any of the rights mentioned in this Clause, You may write to Us at the Email ID provided in Annexure A below.

    5. It is Your responsibility to ensure that any information You provide to Us remains accurate and updated.

  9. RIGHT TO UNSUBSCRIBE

    1. ​You always have the option to not provide information by choosing not to use the Platform or a particular feature thereof (where such feature is available for opt-out). We may automatically use Our available technology to retain Your preferences. 

    2. When You update information, We usually keep a copy of the previous version for Our records. If You do not want to receive updates from Us, please update Your preferences or write to Us at the Email ID provided in Annexure A below. However, opting out of updates still governs Your use of the Platform under the Terms of Use and Privacy Policy.

  10. MISCELLANEOUS - The terms of this Privacy Policy may be read in to the Terms of Use and any terms with respect to governing law, dispute resolution, indemnity, limitation of liability, severability, waivers, foreign jurisdiction, notices, or such other term as may be applicable, as provided in the Terms of Use shall apply to this Privacy Policy and are deemed to be incorporated here by reference.

  11. GRIEVANCES - We strive to redress the concerns of Users expeditiously. An aggrieved User may report the concern to the grievance officer who shall redress the grievances within 1 (one) month from date of receipt of such grievance.

  12. CHANGES TO THIS PRIVACY POLICY

    1. We reserve the right to update or change Our Privacy Policy at any time and You should check this Privacy Policy periodically. Your continued use of the Service after We post any modifications to the Privacy Policy on this page will constitute Your acknowledgment of the modifications and Your consent to abide and be bound by the modified Privacy Policy.

    2. If We make any material changes to this Privacy Policy, We will notify You either through the email address You have provided Us, or by placing a prominent notice on the Platform.
